What is it and what is it for?

This public register identifies and guarantees the capacity and solvency of the registered organisations. It is an instrument that has permanent and up-to-date information on the Valencian agents involved in development cooperation. The aim of the register is to support the calls for funding managed by the governing body in the field of international development cooperation.

* FUNCTIONS OF THE REGISTER 1. Register the agents involved in international development cooperation in the Comunitat Valenciana. 2. Update the registration details and, where appropriate, the cancellation of registrations. 3. Issue certificates related to the details contained on the Register. 4. Constitute an information database where the information may be used by the competent management body in matters of international development cooperation for statistical and research purposes on the reality of development cooperation in the Comunitat Valenciana. This information may be published as a result of this use, in accordance with the provisions of Comunitat Valenciana Law 5/1990, on Statistics. 5. Create an archive of the documentation on the registered entities for assessment, where appropriate, in the calls for funding managed by the governing body responsible for international development cooperation. 6. Facilitate consultation of the documents and information contained on the Register, under the conditions provided for in Law 39/2015 and in Organic Law 3/2018, dated 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights. * EFFECTS OF REGISTRATION 1. Entry on the Register will not have incorporative effect. 2. Decisions on entry, amendment and deletion from the Register will take effect from the date of the decision ordering said effect. 3. Entities registered on this register may be exempted from submitting the required documentation already included therein, in the funding application procedures provided for in Article 19 of Law 18/2017. * SUCCESSION OF REGISTERED ENTITIES 1. Entities registered on the register which, as a result of mergers, takeovers or changes of legal form, change their tax identification number are obliged to re-register. If they do not do so, they are obliged to notify the corresponding modification of their details. 2. In this case the registration decision will recognise length of registration for the purposes of entry on the Register, and will ensure the accreditation of the transfer of the rights and obligations of the pre-existing entities to the new entity or, as the case may be, to the remaining entity.

a) Be a private law entity legally constituted in Spain on a non-profit basis. For the United Nations Agencies and the national committees or organisations representing them, the provisions laid down in international law and their recognition by domestic law will apply. b) Their statutes or articles of association must expressly state that their aims and objectives, as well as the activities they carry out, include international development cooperation. c) They must possess full legal capacity and be able to act. d) Have a registered office or permanent regional office in the Comunitat Valenciana. e) The organisation must have a structure capable of sufficiently guaranteeing the fulfilment of its aims, justifying that it has its own material and personal resources that guarantee the sustainability of the activities it carries out. f) It must not be directly or indirectly dependent on any public administration or public sector bodies, be they local, regional, state or international. A dependent relationship is presumed when more than 30 per cent of the governing bodies are made up of persons acting on behalf of public administrations or public sector bodies.

REGISTRATION Agents in the Comunitat Valenciana that are working in International Development Cooperation may be registered on the Register, as provided for in Law 18/2017: 1- Private law entities legally constituted in Spain on a non-profit basis. 2- The national committees or organisations representing the United Nations agencies in Spain, with headquarters or regional office in the Comunitat Valenciana. 3- International organisations and institutions working in international development cooperation, provided they have a head office or permanent regional office in the Comunitat Valenciana. International financial institutions will not be considered as being included in these categories.

Documentation and forms

1. The application for registration must be accompanied by the following MANDATORY DOCUMENTATION: a) Identification documentation for the entity. b) If the application is not submitted using the entity's digital certificate, or if the representative is not registered on the Generalitat Valenciana's Representatives Register, documentation certifying that the applicant represents the applicant entity. c) Documentation certifying the delegation or powers of attorney in favour of other persons representing the applicant entity. d) Unless express authorisation is given to consult the relevant register, a certificate of registration on the relevant public register must be submitted, depending on the legal nature of the entity. e) Certificate of incorporation of the entity. f) Statutes of the entity or, where applicable, current operating rules. g) Agreement on the composition of the governing bodies duly accompanied by a certificate signed by the person who is the secretary of the entity, that is approved by the person who is the president of the entity, or equivalent document. This certificate must state the name, registered office, registration number, date of registration and, if applicable, the date of the last update, and the authorised representatives. h) If applicable, certifications issued by a public administration, official body or private financing entity, which reliably certifies the execution of the related projects, stating: · Name of the project or programme. · File code or number. · Location the activity took place. · Duration. · Start and end date. · Total cost of the action and of the funding awarded. It will not be necessary to present these certificates for projects or programmes funded by the Generalitat, as listed in the application form, which are managed by the competent management body in the field of development cooperation. i) Organisational chart for the entity and its offices in the Comunitat Valenciana, including the composition of its governing, administrative and management bodies, of the head office and of the branch in the Comunitat Valenciana; as well as a list of the posts within these bodies and the system dedicated to the functions of governance, administration and management for each of the posts at the head office and at the branch in the Comunitat Valenciana. j) Annual report on the entity's activities for the last year. k) Accounting and income statement for the last financial year, including balance sheet, profit and loss account and financial report for the previous year, or the latest audited financial statements, all signed by an authorised person in compliance with the articles of association. l) In relation to the registered office or permanent regional branches or establishments in the Comunitat Valenciana: document accrediting the ownership, rental or, where applicable, agreement, certification or document accrediting the transfer or provision of premises or their establishment in the name of the applicant organisation. 2. Presentation of the application for registration will entail authorisation by the applicant organisation for the managing body to obtain directly from the corresponding administrative bodies accreditation regarding compliance with its tax and Social Security obligations, as well as accreditation of compliance with other obligations deriving from receiving funding. If this authorisation is given, the organisations will not be required to provide the corresponding certificates. In the event the applicant organisation objects to the managing body directly obtaining this information, it must expressly state this in the application, and it must provide the corresponding supporting documents. If the entity is exempt from accrediting the points established in this section, it must provide the corresponding regulation or administrative act granting said exemption. 3. The documentation will be submitted electronically using a digitised copy procedure for the original document. In this case, the digitised copies submitted must be true to the original under the responsibility of the applicant or representative. The Administration may require the original document to be shown in order to compare the electronic copy submitted, in accordance with the provisions of the regulations governing administrative procedures. 4. Applicants may submit, together with the application, the additional documentation provided for in the Annex to Decree 19/2020. However, this documentation and any updates to the registration details may be provided at any time by means of the electronic document submission procedure.

- The application form is to be submitted by electronic means ONLY. - In accordance with Article 16.8 of Law 39/2015, the submission of the application in a form other than online will be considered as an application that has not been submitted. Applications must be addressed to the governing body responsible for development cooperation within the Generalitat.

The person in charge of the Generalitat management centre for development cooperation is responsible for issuing decisions on registration or refusal relating to inclusion in the Register. The maximum period for deciding on and notifying the decision on registration or refusal of registration will be three months from the date on which the application was submitted to the electronic register. If the maximum period has elapsed without the express decision having been notified, the entity may consider its application to have been accepted. The maximum period for resolving and notifying the resolution will be suspended in accordance with the provisions laid down in Article 22 of Law 39/2015. An appeal may be lodged against the decision on registration or refusal of registration, in the manner and within the time limits set out in Law 39/2015.
